Terms of Service

These Terms of Service ("Terms") govern your access to and use of the services provided by ZIAYING LLC, a limited liability company registered in the State of New Mexico, USA, operating as "Lustre" ("Lustre", "we", "us", or "our"). By requesting, ordering, or using our services, you agree to these Terms. If you do not agree, please do not use our services.

1. Services

Lustre provides AI-assisted photo editing and image-finishing services, including portrait and beauty retouching, product and e-commerce editing, color grading, background removal and compositing, photo restoration, and upscaling and enhancement (collectively, the "Services"). Deliverables are provided as digital image files.

2. Accounts & Credits

A verified Google account is required. Lustre does not grant free credits. Credits are prepaid, have no cash value, and are used at the displayed rate when you submit an image generation request. One credit currently creates one image.

3. Fees & Payment

All credit packs are charged in US Dollars (USD). Payments are processed by Stripe, Inc. We do not collect or store your full card details. You are responsible for applicable taxes.

4. Generations & Delivery

Generation times are estimates and may vary. Results appear in your private account history. A credit is returned automatically when our system records a blocked or failed generation. A successfully generated image consumes the stated credits because it incurs processing costs.

5. Generative Results

AI output is probabilistic. We do not guarantee an exact pose, color, facial detail, composition, or interpretation of a request. If you want another variation, submit a new generation request.

6. Your Content & Rights

You retain ownership of the images and materials you submit to us ("Client Content"). You represent and warrant that you own or have all necessary rights, licenses, and consents — including any model or property releases — to submit the Client Content and to have it edited. You grant Lustre a limited, non-exclusive license to store, process, and edit Client Content solely to provide the Services.

7. Deliverables & Intellectual Property

Subject to these Terms and applicable law, you may use generated Deliverables for your intended purpose. We do not use private uploads or results in our public portfolio unless you separately give us permission.

8. Acceptable Use

Lustre is strictly safe for work. You may not submit or request nudity, sexual or fetish content, underwear or transparent-clothing edits, sexualized poses, violence, gore, illegal content, unlawful impersonation, or content you lack permission to edit. People must remain fully clothed. Requests and images may be automatically checked and refused.

9. Processing Providers

Images are transmitted to service providers needed to operate Lustre, including OpenAI for safety classification and image editing, our hosting provider, and Stripe for payments. Their processing is governed by their applicable terms and privacy practices.

10. Warranties & Disclaimer

We provide the Services with reasonable professional skill and care. Except as expressly stated in these Terms, the Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, to the fullest extent permitted by law.

11. Limitation of Liability

To the maximum extent permitted by law, the total aggregate liability of ZIAYING LLC arising out of or relating to the Services shall not exceed the amount you paid for the specific engagement giving rise to the claim. We shall not be liable for any indirect, incidental, special, or consequential damages, or loss of profits or data.

12. Indemnification

You agree to indemnify and hold harmless ZIAYING LLC and its members and agents from and against any claims, damages, or expenses arising out of your Client Content or your breach of these Terms.

13. Cancellation & Refunds

Cancellations and refunds are governed by our Refund & Cancellation Policy, which forms part of these Terms.

14. Governing Law

These Terms are governed by the laws of the State of New Mexico, USA, without regard to its conflict-of-law principles. Any disputes shall be subject to the exclusive jurisdiction of the state and federal courts located in New Mexico.

15. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date above reflects the most recent version. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
